Terms of Service

By accessing or using voicememotranscript.com ("the Service"), operated by Dictate ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all visitors, users, and subscribers.

Dictate is a web-based voice transcription service that converts audio recordings — primarily Apple Voice Memo files in .m4a format — into text. The Service supports English and Chinese (Mandarin) transcription powered by the Whisper AI model via Groq.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

You must be at least 13 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement and that all information you provide is accurate and complete.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Upload audio recordings of other individuals without their knowledge and explicit consent. Recording someone without consent may violate wiretapping and privacy laws in your jurisdiction.
• Upload audio containing illegal content, including but not limited to content that constitutes harassment, threats, defamation, or infringement of intellectual property rights.
• Attempt to reverse-engineer, scrape, or otherwise extract data from the Service beyond your own transcription results.
• Use the Service to process audio on behalf of third parties in a way that circumvents per-account usage limits.
• Attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Use automated scripts or bots to upload files or interact with the Service without our written permission.

We reserve the right to suspend or terminate your account if we determine, at our sole discretion, that you have violated these terms.

You retain all ownership rights to the audio files you upload and the transcriptions produced from them. By uploading content to the Service, you grant us a limited, temporary license to process that content solely for the purpose of providing the transcription service.

We do not claim ownership of your content, and we do not use your audio or transcriptions to train AI models or share them with third parties beyond what is described in our Privacy Policy.

Access to Dictate requires a paid subscription. We offer monthly and annual billing cycles. All payments are processed securely by Creem. By subscribing, you authorize Creem to charge your payment method on a recurring basis at the start of each billing period.

• Auto-renewal. Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date.
• Price changes. We reserve the right to change subscription prices. We will notify you at least 14 days in advance of any price increase, and the new price will apply at your next renewal.
• Usage limits. Each plan includes a monthly usage allowance (e.g., up to 5 hours of audio per month). Unused allowance does not roll over.
• Cancellation. You may cancel your subscription at any time through your Account settings page. Cancellation takes effect at the end of the current billing period, and you retain access to the Service until that date.

We offer a 7-day money-back guarantee for new subscribers. If you are unsatisfied with the Service within 7 days of your initial purchase, contact us at support@voicememotranscript.com and we will issue a full refund, no questions asked.

After the 7-day window, subscription fees are non-refundable, including for partial billing periods. If you cancel mid-period, you will not receive a prorated refund but will retain access through the end of the paid period.

The Dictate name, logo, website design, and all software underlying the Service are the intellectual property of Dictate and are protected by applicable copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without our prior written consent.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that transcription results will be perfectly accurate.

Transcription accuracy may vary depending on audio quality, background noise, accents, and other factors. You are responsible for reviewing and verifying all transcription output before relying on it.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DICTATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

We may terminate or suspend your account immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us or using the account deletion option in your Account settings. Termination does not entitle you to a refund except as described in the Refund Policy above.

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation, and if unsuccessful, through binding arbitration or the courts of competent jurisdiction.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you by email. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
